Terms of Use

Latest change: Clarified retention: when a plan or trial expires without renewal, the account becomes read-only and is then suspended; data is permanently deleted from the live system within 30 to 180 days after expiry depending on the case, after confirmation by hOne; backups are created and cleaned up automatically on a rotation schedule and removed within at most 12 months.

This English text is a courtesy translation. The Vietnamese version prevails in case of any discrepancy.

These Terms (together with the Acceptable Use rules) govern access to and use of the hOne platform provided by Hao Quang Viet Software Co., Ltd ("Hao Quang Viet", "we"). By ticking the consent box and registering for a trial, or by using hOne, you confirm that you have read, understood and accepted the terms below together with the Privacy Policy. These Terms form part of an electronic transaction under the Law on Electronic Transactions 2023 and the regulations on e-commerce (Decree 52/2013/ND-CP, as amended by Decree 85/2021/ND-CP).

1. The service and who may use it

hOne is a software-as-a-service (SaaS) platform that helps businesses manage customers, sales, finance, human resources, omnichannel communication, tasks, documents, call centers and artificial intelligence (AI) features. Each business is given its own domain in the form companyname.hone.vn and its own database. The service is intended for organizations, businesses and individuals aged 18 or older with full civil legal capacity; the registrant represents that they are authorized to act on behalf of the organization they register.

2. Accounts and user responsibilities

Registration information must be accurate, complete and kept up to date. Phone numbers are verified by an automated call that reads out a code, and this call may be recorded; email is verified by a link or a Google account.
A business's administrators are responsible for issuing and revoking employee accounts, assigning permissions, safeguarding sign-in credentials, and all activity arising from the business's account.
You must notify us immediately if you suspect unauthorized access to an account. Each organization/individual may create only one trial account; we may refuse or cancel duplicate or fraudulent registrations.
The business is solely responsible for the lawfulness of the data it enters into hOne and for obtaining consent or another legal basis when processing the personal data of its own customers and employees.

3. Acceptable use

When using hOne, you must not:

Violate Vietnamese law, including the Cybersecurity Law 2018 and personal data protection regulations, or infringe the lawful rights and interests of other organizations or individuals;
Store, transmit or distribute prohibited content: content against the State, incitement to violence, false information causing public alarm, content that insults honor or dignity, pornographic or depraved content, fake news, fraud, gambling, prohibited goods and services, or content infringing intellectual property rights;
Send unauthorized spam or mass advertising messages or calls, violate regulations against spam email, spam messages and spam calls, or call numbers on do-not-call lists;
Impersonate others, collect information without authorization, spread malware, scan, attack, bypass or disable security mechanisms, or gain unauthorized access to others' systems or data;
Use a trial account to exploit resources (cryptocurrency mining, mass email/message sending, using AI beyond ordinary use), or copy, resell or sublicense the service without written approval;
Decompile or disassemble source code, or deliberately overload the system.

We may remove violating content, suspend or terminate accounts, and provide information to competent authorities upon a lawful request, without refunding fees for violating accounts.

4. Trials, plans and payment

Every registration begins with a free trial plan according to the plan you choose on the form, with the trial period and limits published at the time of registration. Upon registration, the account may be activated immediately or placed on a waiting list depending on system capacity.
If the trial or plan expires without an upgrade or renewal, the account becomes read-only, is then suspended, and data is handled under section 8.
Fees follow the price list published at hone.vn or a separate quotation/contract. Prices are shown in Vietnamese dong and are exclusive of VAT unless stated otherwise. E-invoices are issued in accordance with the law.
Payment is made in advance by period (month/year) or by usage for usage-based services. If payment is overdue, we may limit or suspend the service after giving notice.
Refunds: the trial plan is free of charge and therefore not refundable. For paid plans, fees for the period already used are not refunded; if you are an individual consumer, your rights under the Law on Consumer Rights Protection 2023 remain guaranteed. Where the service cannot be provided because of our fault for longer than the service level commitment allows, we will refund or credit the fees corresponding to the period of interruption as agreed or as set out in the contract.

5. Bundled AI tokens and usage-based services

The monthly bundled AI tokens of each plan (shown on the registration page) are a promotional benefit, not a payable sum of money; they are not convertible into cash and do not roll over to the next period. The bundled amount may be changed, increased or reduced, or discontinued at any time under hOne's policy; we will endeavor to give prior notice in the admin interface or by email.
AI usage above the bundled amount (if the business enables it and it is permitted) is charged at the price list in effect at the time of use.
VoiceAI / AI voice call center is charged per minute of calls (according to the published price list or agreement); duration is measured by the system's records and rounded as set out in the price list. The business is responsible for the script content, the list of numbers called, and compliance with regulations on advertising calls, call recording and notifying call recipients.
AI-generated results may be inaccurate; the business should verify them before using them for important decisions. Other services are charged separately: electronic signing, SMS, telecom calls, and storage beyond the plan.

6. Data and privacy

The business owns the data it enters into hOne. We process data only to provide the service, in accordance with the Privacy Policy and any data processing agreement.
The business may export its data (Excel/CSV, PDF) while using the service and during the retention period after termination.
By consenting, you authorize the processing of registration personal data, the recording of the verification call, and the transfer of data to processors (including overseas AI providers) as described in the Privacy Policy.

7. Service levels (SLA)

We strive to keep the service stable, back up data daily and give advance notice of planned maintenance. The trial plan is provided "as is" with no service level commitment.
For paid plans, service levels (uptime, support response time, compensation) follow the signed contract or service appendix.
Third-party services (Zalo, Meta, Google, banks, e-invoice providers, telecom carriers, etc.) operate under their providers' terms; we are not responsible when a third party changes, interrupts or discontinues its service.

8. Expiry, retention and deletion of data

When a plan or trial expires and is not renewed or upgraded, the account becomes read-only and is then suspended; during this time you can still renew, upgrade or request a data export.
The account's business data is permanently deleted from the live system within 30 to 180 days after expiry, depending on the case, after review and confirmation by hOne; deleted data cannot be recovered.
Backups are created automatically and cleaned up automatically on a rotation schedule; every backup is removed within at most 12 months.
You may request earlier deletion of your account and data by emailing support@hqv.software. Data that the law requires to be retained (records, logs, evidence of consent) is kept for the statutory period.

9. Intellectual property

hOne, hChat, hTask & Projects, hPass, hCheckin and hCall, together with their source code, interfaces, documentation and trademarks, are the property of Hao Quang Viet or its licensors. You are granted a non-exclusive, non-transferable right to use them while the service remains in effect. Data and content entered by the business remain the business's property.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect damages, loss of revenue, loss of profit or business opportunity, data loss caused by user error, or interruptions beyond reasonable control (network infrastructure incidents, natural disasters, acts of third parties, changes in law).
Our total liability to each customer, if any, shall not exceed the total fees the customer paid for the service in the 12 months immediately preceding the event giving rise to the damage (for the trial plan: no liability for compensation arises), except in cases of our intentional misconduct or serious breach, or where the law does not permit exclusion/limitation.
The business shall indemnify us for damages and claims arising from the business's breach of these Terms or of the law when using the service.

11. Suspension and termination

You may stop using the service at any time. We may suspend or terminate the service if you breach the Terms, upon the request of a competent state authority, where there is a security risk, or when we discontinue the service (with reasonable notice). Provisions on data, intellectual property, limitation of liability and dispute resolution remain in effect after termination.

12. Changes to the Terms

We may update the Terms; the new version states its version number and effective date, is posted on this page and is notified by email or in the app. Continued use after the effective date constitutes acceptance of the new version, unless the law requires separate consent.

13. Governing law and dispute resolution

These Terms are governed by the law of the Socialist Republic of Vietnam. Disputes shall first be resolved through negotiation and good-faith mediation within 30 days from the date a party gives written notice; if unsuccessful, they shall be brought before the competent People's Court in Ho Chi Minh City, unless the parties agree otherwise in a contract or the law provides otherwise (including regulations on consumer dispute resolution).

Annex: notes specific to the mobile apps

The hChat, hTask & Projects, hPass, hCheckin and hCall apps (and any future app) share these Terms. The apps are free with every hOne plan and need a hOne account issued by your company; issuing, revoking and locking accounts and the scope of use are your company's decisions. The terms of Google Play or the Apple App Store, where you download the app, also apply. For personal data see the Privacy Policy (per-app annex).
